Not All Disability Claims Are the Same Find the Right Ones for You
Not sure which disability benefits you qualify for? Here’s a quick guide to help you understand your options:
Social Security Disability (DIB/SSDI & SSI)
- DIB/SSDI: If you’ve worked and paid into Social Security but can no longer work due to a medical condition, you may qualify. After approval, you may be eligible for Medicare after 24 months.
- SSI: If you have little to no income or assets, you may qualify regardless of work history. Approved applicants typically receive Medicaid immediately.
- Many claims are denied initially due to missing evidence or incorrect paperwork. We guide you through the process and help strengthen your case for approval.
Virginia Retirement System (VRS) Disability Retirement
- If you have a medical condition that prevents you from performing your job and is likely to be permanent, you may qualify for VRS Disability Retirement if you are:
- A Member of the Judicial Retirement System.
- A state employee in Plan 1 hired before January 1, 1999, who did not elect the Virginia Sickness and Disability Program (VSDP) during open enrollment periods in 1999 and 2002.
- A political subdivision or school division employee in Plan 1 or Plan 2.
Long-term Disability (ERISA) Claims
- Employer-provided LTD (Long-term Disability) plans are regulated under ERISA (Employee Retirement Income Security Act) and often involve delays and denials from insurance companies.
- Private LTD (Long-term Disability) policies are available for some workers but require a thorough application process.
- Workers’ Compensation vs. ERISA: Workers’ Compensation covers on-the-job injuries, while ERISA covers long-term disabilities regardless of where they occurred.
