Do I qualify for disability in Hampton Roads?

The Social Security Administration (SSA)  has a five-step process to determine if you are disabled. If you qualify, you can win your case at either step 3 or step 5.

1. Do you have a condition that will or has prevented you from working?

If you expect to be unable to work for at least 12 months, or are working but earning less than $1,000 per month, go to step 2.

2. Is your condition severe?

Does your condition limit your ability to do basic work-related activities? If your condition is this severe, go to Step 3.

3. Does your condition meet or equal a “listing”?

SSA publishes a “listing of impairments.” Your health problem must be as severe as what is stated in that listing. This is called “meeting a listing.” Most claimants do not meet one of these listings. If you do, you win your case at this step!

If you do not meet a listing, go to Step 4.

4. Can you do the work you did previously?

Are you able to perform any jobs that you had within the last 15 years? If not, go to Step 5.

5. Can you do any other type of work?

Can you perform any other work with your education, work experience and physical and mental limitations? If you cannot, you win benefits at this step.
